Basically, the buyers who could not afford higher costs do not consider Home Inspection a priority. They even go for the cheapest home inspection. Usually, Licensed Home Inspection NJ is very costly and it takes a huge span of time too. These days home inspection cost is getting highly affected because of the vast competition in the market.
Factors behind the cost of home inspection:
Let's have a look at different factors behind the Home Inspection NJ.
- Time taken for Inspection: The basic reason behind higher cost of inspection is the time taken for the inspection. Lesser the time lesser will be the cost.
- Licensed or experienced Inspector: If you are approaching a licensed and experienced inspector for Home Inspection then definitely you have to pay a heavier bag of bucks.
- Geographical location: It has been observed that geographical location also plays an important role in the home inspection prices NJ.
- Market competition: These days to let down the competitor's business, many inspectors facilitate you with the same amenities at a lower cost.
Why it is important to conduct home inspection?
Next major question is why it is important to conduct home inspection NJ. As we all know for buying a house, one has to take loan of some amount. To slake the bank's expectation, buyer has to go for Home Inspection. This inspection ensures the bank that it is not investing in any bad property. The two cancers may be referred to as colorectal cancer. Colon cancers generally begin as noncancerous polyps that grow into cancer. Many people with colon cancer do not have signs and symptoms or develop them in the later stages in the illness. Appropriate tests could be in a position to discover symptoms of colon cancer prior to symptoms develop. This consists of fecal occult blood tests as well as a colonoscopy.
Bowel Habits
A prolonged alteration of bowel habits might be one of the colon cancer signals and symptoms. They could consist of diarrhea or bowel obstruction. There may be a visible distinction of the consistency of the bowel movements for around a couple of weeks. There might also be feelings that your bowels are not emptying entirely, the Mayo Clinic notes. Symptoms may be limited or full intestinal congestion. Bowel habits usually alter just before congestion occurs.
Rectal Swelling
Bleeding might take place in the rectum or there may be blood in the stool. Colon cancers usually hemorrhage slowly, in accordance with the Merck Manuals. The stool may be streaked or mixed with blood, however the blood isn't always observed. The initial sign for many people with colon cancer is bleeding throughout a bowel movement.
Abdominal Pain
Warning signs may well include abdominal discomfort, cramps, uncommon times of gas or discomfort. Pain along with tenderness could be sensed in the lower abdomen. Bowel motions and being seated could be very painful. Many people having colon cancer initially see a medical doctor because of abdominal pain without being aware of the underlying cause.
Exhaustion
Fatigue and weakness might be accompanied by unexplained weight reduction. The swelling of the colon, which usually can't be seen, can trigger the weakness. For some individuals tiredness may be the only manifestation of colon cancer.

Fabricio Werdum snaps Mike Russow?s win streak at UFC 147
Fabricio Werdum made his case to join the crowded top of the UFC's heavyweight division with a knockout of Mike Russow at UFC 147 in Brazil on Saturday night.
Werdum bloodied Russow's face early in the clinch. He leveled Russow with an uppercut, then followed with several punches and hammerfists until the fight was stopped at 2:28 in the first round.
As the crowd chanted his nickname, "Vai Cavalo," Werdum jumped on top of the cage to celebrate and nearly fell off. Once he recovered, Werdum asked for a title shot against Junior dos Santos.
"I respect 'Cigano,' but I'm ready for him," Werdum said after the bout.
Werdum was knocked out by dos Santos when they fought in 2008. Since then, Werdum moved to Strikeforce, where he beat Fedor Emelianenko, but lost to Alistair Overeem. He now has two wins back in the UFC.
This is Russow's first loss since he was submitted by Sergei Kharitonov in 2007.

Father Killed Jesus Mora Flores, Who Molested His Daughter, Texas Cops Say (POLL)
The man who police in Texas say was killed after sexually assaulting a rancher's daughter was identified over the weekend.
Jesus Mora Flores was reportedly beaten to death on June 9 after a 23-year-old father found his 4-year-old daughter half naked with Flores at their ranch on the outskirts of Shiner, officers told CNN.
Lavaca County sheriff's deputies told the station that the unnamed father had sent his daughter and her brother off to feed the family's chickens. A little while later, the boy returned and told his dad that someone had taken his sister.
The father then found 47-year-old Flores -- who came to the ranch with a family friend -- sexually abusing his daughter and allegedly beat him to death with his fists.
Share your vote on Facebook so your friends can take this poll
Sheriff Micah Harmon has said that he will not charge the father, but the case will be presented to a grand jury to consider charges.
The father called 911 after the incident, reporting that Flores was on the ground and unresponsive. Harmon told reporters that the man appeared "very remorseful" and didn't know he had killed the abuser.
"You have a right to defend your daughter," Harmon told CNN at the time. "[The girl's father] acted in defense of his third person. Once the investigation is completed we will submit it to the district attorney who then submits it to the grand jury, who will decide if they will indict him."
The 4-year-old girl went to the hospital after the attack, and "besides the obvious mental trauma," is going to be OK, Harmon said.

Andy Samberg Lands New TV Gig
'SNL' alum will play title character on BBC series 'Cuckoo.'

It's been less than two weeks since Andy Samberg announced his departure from "Saturday Night Live," and he's already got plans to return to the small screen.
The "That's My Boy" star will appear in a six-part comedy series on the BBC titled "Cuckoo," the network announced. British funnyman and "The Inbetweeners" actor Greg Davies will also star in the show, filming this summer. The series will follow parents who are stunned to meet their daughter's new husband, "a self-appointed spiritual ninja," played by Samberg.
Samberg's Cuckoo is "a slacker full of outlandish, New Age ideas" who is taken in by the Thomas family as he embarks on newlywed life with his bride. Davies plays the father, Ken Thomas. The cast is filled out by Helen Baxendale, playing mom Lorna, and Tamla Kari, who plays their daughter. The series will air later this year on the network.
"BBC Three continues to break new comedy. 'Cuckoo' is both original and unique," BBC Three executive Zai Bennett said in a statement, also showing love to the show's writers, Robin French and Kieron Quirke. "We're delighted to be announcing this exciting new sitcom with such an illustrious cast from two of my favorite new writers."
Executive producer Ash Atalla added, "The best of British meets the toast of Hollywood. We hope 'Cuckoo' cements the special relationship between our two great countries. I imagine Obama and Cameron will be watching closely."
When MTV News caught up with Samberg shortly after he announced he was leaving "SNL," he opened up about the things he'll miss most about working on the series. "I've been saying it a lot — I'm going to miss all of my friends and the people I work with," he said. "I love them all so much, and I'm hoping to stay in touch with them."
30 under 30: Exploring Nature with the Tools of Physics
Meet Eldad Kepten, 28, one of the up-and-coming physicists attending this year's Lindau Nobel Laureate Meeting
June 12, 2012
Image: Courtesy Eldad Kepten
The annual Lindau Nobel Laureate Meeting brings a wealth of scientific minds to the shores of Germany?s Lake Constance. Every summer at Lindau, dozens of Nobel Prize winners exchange ideas with hundreds of young researchers from around the world. Whereas the Nobelists are the marquee names, the younger contingent is an accomplished group in its own right. In advance of this year?s meeting, which focuses on physics, we are profiling several promising attendees under the age of 30. The profile below is the fourth in a series of 30.
Name: Eldad Kepten
Age: 28
Born: Israel
Nationality: Israeli
Current position: Ph.D. student, Bar Ilan University
Education: Bachelors degree, Hebrew University of Jerusalem
What is your field of research?
I am studying the stochastic dynamics of chromatin (DNA) in the cellular nucleus with advanced microscopy and single particle tracking. By building a physical framework for this motion, we can identify key factors in the nuclear structure and function as well as expand the field of stochastic polymer dynamics.
What drew you to physics, and to that research area in particular?
I have always been fascinated by the ability to identify and explain natural processes through the tools of physics and mathematics. The field of biophysics applies these powerful tools to fundamental questions about our own bodies and environment, with immediate implications on human health and well-being. The complex research area of nuclear architecture presents challenging demands on mathematical analysis and physical modeling, as theories are constantly confronted with new findings. Thus, I must continuously challenge my own knowledge and assumptions, a task I find delightful.
Where do you see yourself in 10 years?
I see myself leading a research group in the areas of biophysics or environmental physics. I believe that in our modern world, physicists should engage nontraditional questions in the fields of health and global welfare. These include questions from the bio-molecular scale, leading the way to efficient and low-cost medical treatments, and up to the global scale where we must deal with the issues of desertification, global warming and sustainable agriculture. Hopefully I can influence these fields and implement the innovative tradition of physics to unresolved questions.
Who are your scientific heroes?
In many ways, Richard Feynman is the scientific role model from which I learn and hope to follow. In his character and actions he illustrates how curiosity, ingenuity and a strong work ethic are at the basis of scientific work. He shows us how inspiration and progress can come from seemingly distant fields with the help of an open mind, that a good physical theory must be simple and clear and that wherever we look, we can find a beautiful phenomena waiting to be studied.
If you had unlimited resources, what kind of research would you conduct?
My dream study would incorporate a lot of nature, complex systems and high relevance for our world. One such system is oceanic ecology. This highly complicated system incorporates a vast amount of spatiotemporal interactions that ultimately give rise to numerous natural wonders and one of humanity?s most important food sources. Currently, acquiring adequate data about our oceans is costly and time-consuming, greatly limiting our knowledge and research capabilities.
Sadly, while we are far from fully understating the workings of our oceanic ecological network, we are also exerting an immense and threatening pressure on it. It is my belief that novel insights regarding how such a network stabilizes, what is the magnitude and interaction of the different components and an ability to model such a system can help us sustain the oceanic wealth for the future generations. These types of questions are at the heart of physics research, and the tools developed from the study and analyses of past systems will certainly prove of great value.
What do you hope to gain from this year?s Lindau meeting?
First of all, I wish to learn from the experience and thoughts of the most acclaimed scientists of our time. In addition I look forward to meeting other enthusiastic young researchers, sharing my ideas and perhaps establishing relationships for future collaborations. Finally, I see this as an opportunity to create personal friendships and connections with people from diverse backgrounds and to learn of their culture.

Texas investment group buys nearly vacant Mesa shopping center

The Superstition Triangle shopping center, located on a 12.75-acre property at the northwest corner of Baseline and Greenfield roads in Mesa, was sold last Friday to 1944 South Greenfield Road LLC. Its sale was one of the largest big-box building sales Phoenix has seen since the market boom in 2006, industry experts said.
A Texas investment group has tapped into the Arizona market for the first time through acquisition of a nearly 164,000-square-foot distressed shopping center in Mesa, which has remained almost entirely vacant for the past three years, for about $4.52 million, according to Velocity Retail Group of Phoenix.

Harper returns to lineup, sparks Nats
Associated Press Sports
updated 10:55 p.m. ET June 11, 2012
TORONTO (AP) - Edwin Jackson labored through a lengthy first inning Monday night. After that, he was lights out.
Bryce Harper had three hits in his return to the starting lineup, Jackson pitched eight strong innings to win consecutive starts for the first time this season and the Washington Nationals beat the Toronto Blue Jays 6-3.
Adam LaRoche hit a two-run homer and Rick Ankiel also connected as the NL East-leading Nationals won their fourth straight and extended their lead over second place Atlanta to three games. The Braves lost to the New York Yankees 3-0.
Jackson needed 24 pitches to get through the first, an inning in which he also gave up a second deck homer to Toronto's Colby Rasmus.
"It was like molasses drying or something," manager Davey Johnson said of Jackson's slow inning.
Things were a whole lot quicker after that. Jackson retired 21 of the next 26 batters he faced, including 10 straight at one stretch.
"Just an unbelievable performance," Harper said. "He had everything working for him, his fastball was good, his curveball, his changeup. He was really effective tonight."
Jackson (3-3) improved to 4-0 in his past seven starts against Toronto dating to July 30, 2008. The right-hander, who had gone eight starts without a win before beating the New York Mets in his last outing, allowed two runs and three hits. He walked three and struck out three.
Jackson credited his turnaround to a strong connection with batterymate Jesus Flores.
"Pretty much what I was thinking, he was thinking," Jackson said. "That always helps when the pitcher and the catcher are both on the same mind frame. I just kept it going, just tried to speed the pace of the game up."
Jackson said he's trying to match or exceed the performances of Washington's youthful starters, including Gio Gonzalez, Stephen Strasburg and Jordan Zimmermann. It's the kind of competition Johnson is happy to see from his deep staff.
"No question about it, everybody is trying to outdo the other guy," Johnson said. "There's some awful good games I'm seeing pitched against some awfully good clubs. It's fun."
Left-hander Sean Burnett came on after Edwin Encarnacion's leadoff double in the ninth and gave up a two-run homer to pinch-hitter Yan Gomes before finishing off the win.
The Nationals pounded out 14 hits, two shy of their season high for a nine inning game, and improved to 5-2 in interleague play this season. Washington has won seven of nine overall.
Harper was held out of the starting lineup Sunday because of back pain. He went 3 for 4 and also walked and scored twice.
Toronto lost starting pitcher Brandon Morrow just nine pitches into the first inning when the right-hander strained a muscle in his left side.
After giving up a leadoff double to Steve Lombardozzi, Morrow (7-4) motioned for the trainer after missing low on a 1-1 pitch to Harper, the second hitter of the game. Following a brief discussion involving manager John Farrell, Morrow walked off the field and down the steps to the clubhouse.
"I felt it on the first pitch to Harper," Morrow said. "I felt like a stabbing in my side when I threw it."
Morrow continued to feel tightness in his lower rib cage after coming out of the game and will be reevaluated Tuesday. Farrell said the injury was "probably substantial."
"He was in considerable pain," Farrell said. "There will be further imaging, further testing in the morning."
Chad Beck came on to replace Morrow and immediately gave up an RBI single to Harper.
"That's never happened to me before," Harper said of facing two pitchers in the same at-bat. "It was kind of weird to go back up there and get into the zone again and get comfortable."
Harper went to third when Ryan Zimmerman reached on a fielding error by first baseman David Cooper, then scored on Michael Morse's sacrifice fly.
Rasmus cut the deficit in half with a solo drive to right in the bottom half, his ninth, but LaRoche responded with a two-run shot to right in the third, his 11th.
Washington tacked on one more in the seventh on an RBI single by Ian Desmond, and another in the eighth on Ankiel's drive to left, his fourth. The homer came off Blue Jays right-hander Francisco Cordero.
NOTES: Nationals OF Roger Bernadina strained his right hamstring while advancing from first to third on a wild pitch in the fourth. He was initially replaced by Xavier Nady, but Ankiel took over defensively in the seventh. Bernadina will be re-evaluated Tuesday. ... Beck was optioned to Triple-A Las Vegas following the game, with LHP Evan Crawford and LHP Aaron Laffey recalled from Triple-A. Toronto will make a second roster move Tuesday to make room on the roster, with Morrow likely headed to the DL. ... The Blue Jays have lost four of five. ... Washington RHP Drew Storen (right elbow) threw off the mound Monday for the second time since undergoing surgery. Storen is not expected to return until after the All Star break. ... Nationals RHP Ryan Mattheus (left foot) will make a second rehab appearance with Class A Potomac on Tuesday, and is expected to work one inning or more. ... The Blue Jays signed 22 draft picks Monday, including first round selection OF D.J. Davis.

A Long March 2F rocket will launch three astronauts aboard a Shenzhou 9 capsule for China's first manned space docking at the mini-space station Tiangong-1. The space lab module has been circling Earth unmanned since its launch last year.
"The Shenzhou 9 will perform our country's first manned space docking mission with the orbiting Tiangong 1 space lab module," the Xinhua news agency quoted Zhou Jianping, chief designer of China's manned space program, as saying on June ).

Zhou's comments came as he accompanied the rocket set to launch the Shenzhou 9 mission to a pad at China's Jiuquan Satellite Launch Center in the country's northwest region.
The mission, Zhou told Xinhua, will be a major milestone for China's space exploration program.
"It means China's spacecraft will become a genuine manned shuttle tool between space and Earth. It can send human beings to space stations or space labs," Zhou told Xinhua. "This will be a significant step in China's manned space flight history." ?[Gallery: Tiangong 1, China's First Space Lab]
?China's Shenzhou 9 mission will mark the fourth human spaceflight for the country, which has been making steady advances since the launch of Chinese astronaut Yang Liwei in 2003 on Shenzhou 5, the country's first human spaceflight. China is the third country to achieve human spaceflight after Russia and the United States.
Since its first flight, China has launched two more manned missions, the two-man Shenzhou 6 flight and three-person Shenzhou 7 mission. Last September, China launched the Tiangong 1 module ? a prototype for a future space station ? into orbit. That launch was followed in November by the unmanned Shenzhou 8 mission, which successfully docked a capsule with the space laboratory twice during the test flight.
The Shenzhou 9 mission will mark China's first human spaceflight to an orbiting module. Earlier this year, space program officials said the mission could also mark the first launch of China's first female astronaut, but a final decision on that is pending, Xinhua reported.

Water war reignites as L.A. resists fixing some Owens Lake dust
The L.A. Department of Water and Power has spent $1.2 billion in accordance with a 1997 agreement to combat the powder-fine dust from a 40-square-mile area of the dry Owens Lake bed. By introducing vegetation, gravel and flooding, the DWP has reduced particle air pollution by 90%.
The efforts have brought a measure of peace in the rural valley where people have long had bitter feelings toward Los Angeles, although a noxious reminder of how much work remains to be done rolled over this tourist town on the afternoon of May 25. Fearsome gusts of desert wind kicked up swirling clouds thousands of feet high and so thick that drivers switched on their headlights and pedestrians scurried about with squinting eyes.
Despite the DWP's efforts, the air quality still doesn't meet federal pollution standards. So the Great Basin Unified Air Pollution Control District has ordered the DWP to expand its reach to an additional 2.9 square miles of lake bed, including areas so remote and geologically challenging that it could cost the utility as much as $400 million to bring them into compliance with federal health standards.
The DWP says the demand is unreasonable. "Just as we're nearing completion of our settlement agreement goal, Great Basin has pushed the goal post further away," DWP General Manager Ron Nichols said.
Water wars have raged over Owens Valley since the early 1900s, when the city had agents pose as farmers and ranchers to buy land and water rights in the valley, then began building the aqueduct to slake the thirst of the growing metropolis more than 200 miles to the south. L.A. diverted so much water via the aqueduct system that it was nearly impossible for local farmers and ranchers to make a living ? a scandal dramatized in the classic 1974 film "Chinatown."
The current standoff is "a rekindling of 'Chinatown,'" said S. David Freeman, who was general manager of the DWP when it struck the agreement in 1997 and believes it should remain intact.
"We are seeing a fundamental reversal of a decade of relative harmony," Freeman said. "If the mayor does not want to leave office labeled a polluter, he ought to think twice about that."
L.A. Mayor Antonio Villaraigosa, who six years ago declared a new era of collaboration with the Owens Valley, declined to comment on the dispute.
The DWP claims that the 1997 agreement contains flaws that set the stage for unforeseen problems and sent costs soaring. For example, the DWP has had to spread more water than anticipated ? yearly costs have grown to about $45 million ? over portions of lake bed where dust pollution exceeds federal health standards.
The utility also argues that geological reports and newly discovered archaeological sites indicate that the lake was smaller in 1913 ? when the aqueduct began taking water south ? than outlined in the 1997 agreement. The DWP is responsible for dust arising only from the portions of the lake bed exposed since 1913. The utility says the State Lands Commission should be responsible for rest of the area, which amounts to about 10 square miles.
In addition, the DWP contends that the agreement unreasonably requires it to control all airborne dust over the lake bed, even though some particles might be blown in from nearby sand dunes and other sources.
"We have no intention of walking away from our responsibility for the dust at the dry Owens Lake bed," Nichols said. "But the reality is that we don't create all the dust out there, never did."
The utility has filed an appeal of the air pollution control district's order with the California Air Resources Board, which will hear the case Friday. The DWP says that if it prevails, the amount of water used for dust control could be cut in half, saving the average ratepayer about $20 a year.
Ted Schade, Great Basin air pollution control officer, said he understands the desire to save money in a tough economy. But the federal Clean Air Act does not say that "close to completion" is good enough, he said.
"The DWP is responsible for controlling the lake bed that is exposed today because of their ongoing water diversions," he said. In addition, state-approved procedures require Great Basin to identify and order treatment of areas that fail to meet federal particulate standards.
Schade conceded that some dust does come from other sources, but he said "they are a small fraction of the dust that comes off the Owens Lake bed."
Environmentalists have a stake in the outcome. A master plan for the lake bed calls for environmentally sensitive flooding strategies, but the plan is on hold until the current dispute is resolved, DWP officials said. Thousands of migrating waterfowl and shorebirds roost on portions of the flooded lake bed.

PARIS (AP) ? One victory Thursday finished Maria Sharapova's climb back to the top of the tennis rankings.
With one more on Saturday, she'll be the French Open champion and complete a career Grand Slam.
Not a bad way to spend springtime in Paris.
Sharapova defeated Petra Kvitova 6-3, 6-3 in the windblown semifinals at Roland Garros. The second-seeded Russian needs a victory over 21st-seeded Sara Errani, a 7-5, 1-6, 6-3 winner over No. 6 Samantha Stosur, to become the 10th woman to win all four major tournaments.
"I always dreamed of being on the final stage here and I finally have that opportunity," Sharapova said. "And I'm more than excited."
When she won match point on a second-serve ace, Sharapova raised her palms to the sky, looked up and smiled ? one of the sport's biggest stars letting the fans and photographers share a special moment.
Sharapova has long been the headliner at almost any tournament she enters, though this latest win will officially put her on the top line of the women's rankings when the new list comes out Monday.
It's a perch that may have felt unreachable three years ago, when the Russian was recovering from shoulder surgery and dropped as low as 126th.
But from that point, she has made a steady climb back. This year, she has won two tournaments and finished runner-up in three more, including the Australian Open. That, plus the performance at Roland Garros, has helped push her back to No. 1, the spot she first captured in 2005 and held for 17 non-consecutive weeks, the last on June 8, 2008.
"It's pretty special," Sharapova said. "A few years ago after my shoulder surgery, I don't know if I had a ranking, but it was over 100. And I thought 'Well, I did it one time. So maybe again, I can try to do it.'"
Her match against fourth-seeded Kvitova, who defeated Sharapova in the Wimbledon final last year, wasn't exactly a walk in the park, but Kvitova struggled with the blustery wind more than her opponent did. And she couldn't get a handle on Sharapova's serve. The Russian placed 78 percent of her first serves in.
"It's tough to return her," Kvitova said. "She plays very fast. It's a different game compared to matches before."
Trailing 4-3 and 40-30 in the second set, Kvitova hit an aggressive return that the chair umpire ruled missed the baseline. A short argument ensued and after the changeover, Kvitova kept glancing at the spot where she thought the ball hit. She went from 30-love in that game to losing the last four points, and Sharapova's last service game was academic ? and punctuated with that ace on her second serve.
Next up is Errani, who played a terrible second set against Stosur but took advantage when the U.S. Open champion got a case of the nerves and started hitting balls five and 10 feet out in the final set.
"It's a semifinal of a slam," Stosur said. "Of course you're going to be nervous."
When her win was complete, Errani toppled to her back and onto the soft, red clay, then looked up to the players guest box, where there was an elated mix of smiles and tears.
"It's incredible for me," Errani said. "I didn't expect it, and I'm here. So, I don't know what to say."
Stosur committed 48 unforced errors, including 21 in the final set, while Errani simply chased and got the ball back, making only 21 unforced errors over the entire match.
Many of Errani's serves spun in at the 70-80 mph range. She finished the match with no aces, compared to 11 for Stosur, and set aside the thought, at least for one day, that power players with power games are the only ones who win big matches at Grand Slam tournaments. The debate will be resumed Saturday when she plays Sharapova. Given the way the past two weeks have gone, there's no counting out the Italian.
Entering Roland Garros, Errani was 0-28 against opponents in the top 10.
Now, she has back-to-back wins against No. 10 Angelique Kerber and No. 6 Stosur, along with victories over past French Open champions Ana Ivanovic and Svetlana Kuznetsova. Which means that on the same day Sharapova officially vaults to No. 1, Errani will reach the top 10 for the first time.
"Maybe my problem always was that I couldn't believe too much to win with the strong players," she said. "But now I beat three in a row. I'm in the final in a Grand Slam. So I have to maybe try to think a bit different."

FOR IMMEDIATE RELEASE
June 5, 2012Landmark Decision Striking Down Proposition 8 Will Stand
Ninth Circuit Denies Petition for Rehearing En Banc Filed by Anti-Marriage Proponents of Prop. 8
*** AFER to Hold National Media Conference Call at 10:30 a.m. PDT ***

San Francisco, CA -- Today, the United States Court of Appeals for the Ninth Circuit denied a request from anti-marriage forces to reconsider its landmark ruling in Perry v. Brown that found California's Proposition 8 unconstitutional. Proposition 8 stripped gay and lesbian Californians of the fundamental freedom to marry.
The American Foundation for Equal Rights (AFER) is the sole sponsor of Perry v. Brown, the federal constitutional challenge to California's Proposition 8. AFER will hold a national media conference call at 10:30 a.m. PDT to discuss the significance and impact of today's order. Speaking on the call will be Plaintiffs' lead co-counsel Theodore B. Olson and David Boies; and AFER co-founder Chad Griffin.
"Today's order is yet another federal court victory for loving, committed gay and lesbian couples in California and around the nation," said AFER co-founder Chad Griffin. "The final chapter of the Proposition 8 case has now begun. Should the United States Supreme Court decide to review the Ninth Circuit's decision in our case, I am confident that the Justices will stand on the side of fairness and equality."
On February 7, 2012, a three-judge panel of the Ninth Circuit concluded that Proposition 8 violates the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. The Ninth Circuit panel majority held:
"Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples. The Constitution simply does not allow for laws of this sort."
The request for a larger eleven-judge panel of the Ninth Circuit to reconsider the case, known as rehearing en banc, is only granted upon a majority vote of the Ninth Circuit's 25 judges in regular active service at the time Proponents' petition was filed.
The Ninth Circuit also rejected Proponents' renewed attempt to impugn the reputation of the United States District Chief Judge who struck down Proposition 8. Unable to defend Proposition 8 on its merits, Proponents claim that the now-retired Chief Judge Vaughn R. Walker was disqualified from ruling on Proposition 8 and that his historic decision should be vacated because he is gay and in a committed relationship. The Ninth Circuit unanimously rejected Proponents' offensive argument, stating: "To do otherwise would demonstrate a lack of respect for the integrity of our federal courts."
